NOTICE OF SHORT-TERM OCCUPANCY AND WAIVER OF TENANT’S RIGHTS
THIS NOTICE OF SHORT-TERM OCCUPANCY AND WAIVER OF TENANT’S RIGHTS (the “Agreement”) is entered into as of the reservation booking date and acceptance by the Occupant (the “Occupant”) and pertains to the temporary and limited use of the Premises described below.
By staying here, you accept the following terms which are designed to clearly and fairly define our roles.
- Premises
The property being rented (the “Premises”) is made available to the Occupant solely for the purpose of short-term occupancy and is not intended for residential tenancy.
- Duration of Occupancy
The Occupant’s reservation period shall commence on the “Check-In” Date at 3:00 PM and end on “Check-Out” Date at 10:00 AM (the “Occupancy Period”).
- Total duration of the Occupancy Period shall not exceed seven (7) days.
- Early check-in or late check-out may incur additional fees and must be pre-approved by the Property Owner or its designated agent.
- In the event that you wish to extend your stay longer than 7 days, then we will require you to book a second license term, and will possibly relocate you from one unit to another.
- Any guest staying longer than 7 days acknowledges and agrees that they may be relocated, and that it is beginning a new 7 day term, and not a continuing license.
- No Landlord-Tenant Relationship
The Occupant acknowledges and agrees that this Agreement does not create a landlord-tenant relationship under applicable laws and statutes, including but not limited to the state of Georgia.
- The occupancy granted under this Agreement is expressly classified as a temporary and revocable license to use the Premises for the specified Occupancy Period only.
- The Occupant waives all rights typically afforded to tenants, including any rights to eviction protections, leasehold estates, or claims of tenancy under state law.
- The Occupant further agrees to pay for all legal costs of the Owner should you fail to vacate in a timely manner.
- Payment Terms
The Occupant agrees to pay the Total Rental Amount per the booking calendar for the use of the Premises during the Occupancy Period. Full payment is due upon booking confirmation.
- Failure to remit payment in full by the required date may result in cancellation of the reservation without further notice.
- Use of Premises
The Occupant agrees to:
- Use the Premises exclusively for short-term lodging.
- Comply with all applicable rules, regulations, and policies provided by the Property Owner.
- Avoid causing any damage, nuisance, or disturbance to the property or neighboring properties.
The Occupant further agrees that no commercial activity, subleasing, or assignment of this Agreement is permitted.
- Security Deposit and Damages
The Occupant may be required to provide a refundable security deposit (“Security Deposit”, which shall be applied toward any damages or violations of this Agreement.
- The Premises will be inspected after check-out, and any damages exceeding normal wear and tear will be billed to the Occupant.
- Waiver of Legal Rights
By checking the “I agree to the terms and conditions”, box on the booking page, the Occupant expressly waives all claims and defenses that may arise under landlord-tenant laws. This waiver includes but is not limited to:
- Protections against eviction or early termination of occupancy.
- Rights to continued possession beyond the specified Occupancy Period.
- Any assertion of a leasehold interest or tenancy at law.
- Termination and Immediate Removal
The Property Owner or its agent retains the right to terminate this Agreement immediately, or at any time upon 24 hours’ notice.
- To the extent that Georgia law allows greater time for tenants under residential leases, you agree that as a licensee in this unit you are NOT a tenant and will not claim to be a tenant.
- Upon termination, the Occupant shall vacate the Premises promptly, without any requirement for formal eviction proceedings.
- If an Occupant do not check out by 10:00 AM on the check out date, the Property Owner or its agent is empowered to remove the belongings of the Occupant from the property.
- The Occupant will be denied further entry to the property.
- Indemnification and Liability
The Occupant agrees to indemnify and hold harmless the Property Owner and its agents from any claims, damages, or liabilities arising from the Occupant’s use of the Premises.
The Occupant recognize that Owner is not responsible for any lost or stolen items during their stay, or left behind.
- Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia.
11. Cancellation Policy
100% refund 14 days before check-in
Otherwise, no refund
12. Entire Agreement
This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements, whether written or oral.
BY CHECKING THE “I AGREE TO THE TERMS AND CONDITION BOX” ON THE RESERVATION FORM, THE OCCUPANT ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
This document is a legally binding agreement and should be reviewed carefully before commencing your reservation.
Conditions
This Privacy Policy governs the manner in which Rooms Every Day collects, uses, maintains and discloses information collected from users (each, a “User”) of the https://roomseveryday.com/ website (“Site”). This privacy policy applies to the Site and all products and services offered by Rooms Every Day.
Personal identification information
We may collect personal identification information from Users in a variety of ways in connection with activities, services, features or resources we make available on our Site.. Users may visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.
Non-personal identification information
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.
Web browser cookies
Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.
How we protect your information
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
Sharing your personal information
We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.
Booking a reservation
The member booking a reservation is required to be present for the entire duration of the same reservation. No exception. (no booking for someone else)
The booking member on any reservation is required to present a form of government issued identification.
Termination of membership
Rooms Every Day can elect at it’s own discretion to terminate a membership at will and without cause.
Agree to hold harmless
Users (host & guest) agree to hold Rooms Every Day harmless for any loss suffered while utilizing this site for any trip booked.
Your acceptance of these terms
By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
Changes to this privacy policy
Rooms Every Day has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
